Section 280E tax rule (Cannabis industry specific) does not apply to Tribal Enterprises. This allows a tribal-owned cannabis business to capitalize on deductions of ordinary & necessary business expenses such as cost of goods, whereas non-tribal enterprises are subject to section 280E.

Tribal businesses are treated as States and, therefore, are Tax exempt on fuel, manufacturing, communications & highway vehicles. Additionally, they are tax exempt from gifts and charitable contributions.
New market tax credits are approved for investors in tribal businesses. Tax credits equaling 39% of their investment can be earned over 7 years (e.g., 5% in years 1-3 and 6% years 4-7).
